Understanding the Planning Process
Planning applications and appeals can be confusing, especially if you are not used to the terminology or the process. This section explains the basics so residents can understand what is happening, what it means, and when they may wish to get involved.
What is a planning application?
A planning application is a formal request to carry out development. The local planning authority (Cherwell DC) considers the proposal against planning policy, site context, technical evidence, and the comments received during consultation.
A planning application on the paddock site is most likely to be considered a ‘minor’ application, meaning the local planning authority should determine the application within 8 weeks.
What is an appeal?
An appeal happens when the applicant challenges a decision, or sometimes when the local authority has not issued a decision within the required period. The appeal is usually considered by the Planning Inspectorate.
From the date of the decision (or from the target decision date if the applicant hasn’t agreed to an extension of time with the local planning authority) an appeal must be submitted to the Planning Inspectorate within 6 months of that date.
What can residents comment on?
Residents can usually comment on matters such as design, scale, layout, traffic, overlooking, loss of privacy, drainage, ecology, trees, and how the proposal fits local policy. It is often most effective to focus on planning issues rather than personal matters.
